Joomlashack Developer Template Club Terms of Service
IMPORTANT INFORMATION
You should carefully read the following Terms and Conditions. Your purchase or use of our products or services implies that you have read and accepted these Terms and Conditions for our Developer Template Club ("Dev Club.")
LICENSE
Joomlashack grants you non-exclusive limited license to use the web templates and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license").
LIMITED USE GRANTED
Your Dev Club membership grants you the rights to use the Joomlashack templates on unlimited domains for the life of the Dev Club.
MODIFICATIONS
You are authorized to make any necessary modification(s) to our products to fit your purposes. However, you may not redistribute or release and modifications as GPL or otherwise. You must also not change or remove the copyright information in the header of the xml descriptor file. Porting to other platforms and content management systems and redistributing as GPL or otherwise is also strictly prohibited. Please contact us if you have any requirements that are not covered by these terms.
The PHP code portions of these commercial templates that interact vialinking with the Joomla CMS are released under the GPL version 2.0 license (http://www.gnu.org/licenses/gpl-2.0.html GNU/GPLv2). Unless otherwise stated, all images, cascading style sheets, non-linked PHP and included JavaScript are NOT GPL, and are released under a proprietary license may not be redistributed or repackaged for use other than those allowed by the Terms of Service.
UNAUTHORIZED USE
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from Joomlashack.
ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Joomlashack.
OWNERSHIP
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Joomlashack. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
RETURN POLICY
Joomlashack LLC does not allow refunds on Dev Club purchases.We only make exceptions with this rule when the product appears to be not-as-described, on a case by case basis, and in agreement of the parties concerned.
WARRANTY
Joomlashack does not warranty or guarantee these templates in any manner. We cannot guarantee they will function with all 3rd party extensions. Browser compatibility should be tested against the demonstration templates on the demo server. Please ensure that the browsers you use will work with the templates as we can not guarantee that Joomlashack templates will work with all browser combinations.
Controlling Law and Jurisdiction
THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW HAMPSHIRE, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF NEW HAMPSHIRE.
Joomlashack reserves the right to change or modify current Terms with no prior notice. Joomlashack's Dev Club has no guaranteed lifespan, and may be terminated, changed, or these terms modified at any time.
